Shared and Reseller Hosting Terms of Service
HIGH RESOURCE USER POLICY
Resources are defined as cpu utilization and / or resource manipulation. ServerPlace.NET may implement the following policy to its sole discretion: When a website is found to be monopolizing the resources available, ServerPlace.NET reserves the right to suspend or terminate that account immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. An agreement is normally reached with a client, allowing them to upgrade their web hosting plan for an additional fee.
Server Use
ServerPlace.NET hosting plans are to be used by the primary owner only. Clients are not permitted to resell, store or give away web-hosting services of their website to other parties, unless they have prior permission from ServerPlace.NET, ServerPlace.NET reserves the right to refuse service and / or access to its servers to anyone it deems necessary. All services provided by ServerPlace.NET may only be used for lawful purposes. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or local law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene. Also prohibited are sites that promote any illegal activity or present content that may be damaging to ServerPlace.NET webservers. Links to such materials are also prohibited. Any illegal activity, including illegal adult content, links to illegal adult content web sites, spamming, cracking or hacking will result in your site being shut down and all your files deleted without warning. Pornographic websites are not allowed. We DO NOT allow Internet-Relay-Chat ("IRC") or IRC bots to be operated on our servers. ServerPlace.NET will be the sole arbiter as to what constitutes a violation of this provision.

ServerPlace.NET does not any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by ServerPlace.NET and its employees. We do not claim any responsibility to what is on your site and we will not be held accountable, action will be taken. ServerPlace.NET reserves the right to revise its policies at any time. You cannot press charges, take legal pursuit, or threaten our ISP(s) or any person(s) or company storing these files, and cannot prosecute any person(s) affiliated with this page which includes family, friends or individuals who run or enter this web site.
Online Activity:
Any attempts to undermine or cause harm to the ServerPlace.Net equipment, network, operations,
or clientele is STRICTLY prohibited.
ServerPlace.Net will pursue legal action to the
fullest extent for all abuse/violation of such.
Any activity deemed damaging or abusive, whether
unlawful or considered to be detrimental to the
operations of ServerPlace.Net, is prohibited.
This includes, but is not limited to:
Denial of Service Attacks (DOS/DDOS)
Unnecessary Port Scans
Mail Bombing
Unsolicited Advertising via IM, Forums,
Newsgroups, Email, etc..
Bulk Email: We understand that bulk email is an
important mechanism for keeping people informed.
However, spamming (unsolicited advertising),
from the ServerPlace.Net network, or
spamvertising (unsolicited advertising of) sites
hosted on the ServerPlace.Net network is
STRICTLY prohibited.
Legitimate bulk email meets the following
criteria:
1) The recipient has confirmed his willingness
to be added to the distribution list of the
mailing, by responding to a verification email,
or, otherwise, verifiably confirming permission.
(Evidence of such must be retained and available
by request.)
2) Messages include: Valid headers, removal
instructions, and information on the method by
which the subscribed address was obtained.
All bulk email senders must post privacy
policies, in association with the sending
domains. Co-registration is not prohibited, but
explanations of the sharing of information must
be both publicly available and included in the
confirmation mechanism for list subscription.
If ServerPlace.Net approaches a client for
evidence of confirmation, this request must be
honoured within 48 hours.
Failure to meet the acceptable criteria for bulk
mail may lead to immediate termination.
Additionally, if such actions have caused mail
servers or IP address ranges on the
ServerPlace.Net network to be blacklisted,
ServerPlace.Net reserves the right to assess a
$100 charge to the customer account. This fee is
set to cover administrative costs associated
with removal from such lists.
Please make an effort to limit outgoing mail on
your account to no more than 1000 pieces per
hour. Large mailings are preferred to be sent
from the hours of 12AM - 8AM EST.
Refund
If we have treated you unfair, or do not meet to the standards of our uptime you will be issued a partial or full refund. We will try our best to resolve a dispute with the client.
Cancellation
If you wish to cancel your shared/reseller account you must give us a 3 day notice. If you fail to do so then you must continue with the remanding period paid for. To cancel your account please email billing@serverplace.net or open up a trouble ticket under the billing department.
Payments
Accounts with payments Over Due 1 day will be Suspended. Accounts with payments Over Due 10 days will be Terminated. If your account is suspended there will be a $3 activation fee.
Fraud
Fraud is something we take very seriously. Please note that we scan all orders for fraud, so if there is a delay in setup please email billing@serverplace.net |
